In Trial No. 17352-2012-0523 undertaken by SHIVA VANDANA, CHANCOSO BLANCA, CHERREZ CECILIA, BASSEY NNIMMO, TENESACA DELFIN, ACOSTA ALBERTO, GONGORA LIDER against BLOCK NATHAN, GILBERT JOHN, REPRESENTATIVES OF THE COMPANY BP, THE OIL COMPANY BRITISH PETROLEUM (BP), JOHN L. GILBERT - REPRESENTATIVE OF THE COMPANY BP, NATHAN BLOCK, there is the following:
SECOND LABOUR COURT OF PICHINCHA.- Quito, Thursday 26 July 2012, 16:58 hrs.- WHEREAS: The competence of this court having been established, by virtue of the drawing of lots, Dr. JOSÉ RAFAEL NUÑEZ RODAS, Investigating Judge of the Second Labour Court of Pichincha, has taken over the present case by virtue of Personnel Action No. 3091 of 28 October 2011.- In light of which, the suit for CONSTITUTIONAL PROTECTION ACTION, assigned with No. 0523-2012, proposed by: VANDANA SHIVA (RESEARCH FOUNDATION FOR SCIENCE, TECHNOLOGY AND ECOLOGY “RFSTE”); BLANCA CHANCOSO (ECUARRUNARI); CECILIA CHERRÉZ (ACCIÓN ECOLÓGICA); NNIMMO BASSEY (OILWATCH); DELFIN TENESACA (ECUARRUNARI); ALBERTO ACOSTA and LIDER GONGORA (member and president of C-CONDEM), against the oil company BRITISH PETROLEUM (BP), in the persons of Messrs. NATHAN BLOCK and JOHN L. GILBERT, representatives of the BP corporation, is clear, complete and fulfills all other legal requirements, the procedure established in Art. 86 num. 2 and Arts. 71, 72, 75 and 88 of the Constitution, as well as Art. 7 of the Organic Law on Jurisdictional Guarantees and Constitutional Oversight, is hereby undertaken. Consequently, the parties are summoned to a PUBLIC HEARING, which shall take place on 3 August 2012 at 9:00 hrs. in the Hearing Room of this Court.- Let note be taken of judicial mailbox No. 1266 indicated by the plaintiffs; Dr. ESPERANZA MARTÍNEZ (member of the organizations OILWATCH and ACCIÓN ECOLÓGICA) is hereby designated as the legal counsel and shall be notified at Calle Alejandro de Valdez N 24-33 y la Gasca in this city of Quito.- Let notice be given to the defendants at the electronic mail addresses indicated for this purpose, that is ( This email address is being protected from spambots.
